What you pay at closing in Florida

Our fee is the closing fee above. The other title costs are set by the state, the county or the insurer, and every one of them is itemized in your quote and on your closing statement.

Florida charges documentary stamp tax on the deed of $0.70 per $100 of the price (Fla. Stat. 201.02), usually paid by the seller; in Miami-Dade County it is $0.60 per $100 for a single-family home (Fla. Stat. 201.031). A buyer with a mortgage also pays $0.35 per $100 in stamp tax on the note (Fla. Stat. 201.08) and a 0.2% intangible tax on the loan (Fla. Stat. 199.133). Title insurance premiums are promulgated by the Florida Office of Insurance Regulation, so they are the same at every title company: an owner's policy on a $250,000 home costs $1,325.

It is negotiable, and the purchase contract decides. By custom the seller pays for the owner's policy in most of Florida, while the buyer usually pays in some South Florida counties such as Miami-Dade and Broward. The buyer pays for the lender's policy when there is a loan.

If the home is in an HOA or a condo association, the association issues an estoppel certificate showing what the seller owes, and Florida law caps the fee for it (Fla. Stat. 720.30851 and 718.116).
