A defect in title — also called a title defect or title flaw — is any issue that challenges the validity of ownership or creates uncertainty about who has the legal right to a property. Title defects range from minor paperwork errors that are easily corrected to serious ownership disputes that can take months or years to resolve in court. Identifying and clearing title defects before closing is the primary purpose of the title search and title examination process.
Common title defects include: errors in public records (misspelled names, incorrect legal descriptions, transposed numbers), missing or improperly executed deeds, unreleased mortgages (the loan was paid off but the satisfaction was never recorded), undisclosed heirs who may have ownership claims, forged documents in the chain of title, unpaid liens (tax, judgment, mechanic's), boundary disputes, adverse possession claims, and fraud or impersonation.
Some defects are straightforward to correct. A misspelled name on a deed can be fixed with a corrective deed or affidavit. An unreleased old mortgage from a lender that has since been acquired can be resolved by contacting the successor institution. Other defects are more complex: if a property owner died without a will and probate was never completed, the title may be clouded by potential claims from unknown heirs. In the worst cases, a quiet title action — a lawsuit asking a court to definitively determine ownership — may be the only solution.
